Terms of Service

Welcome to Kitchin. These Terms of Service (“Terms”) govern your access to and use of the Kitchin app and website (the “Service”), provided by Kitchin, Inc. (“Kitchin”, “we”, “us”). By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

1. Your account

• You must be at least 13 years old (or the minimum age in your country) to use Kitchin.
• You're responsible for keeping your login credentials secure and for activity under your account.
• Please give us accurate information and keep it up to date.

2. Your content

You keep ownership of the recipes, photos, notes, and other content you add to Kitchin (“Your Content”). You grant us a limited licence to host, store, process, and display Your Content solely to operate and improve the Service for you — for example, to parse a recipe, build a shopping list, or sync across your devices.

You're responsible for ensuring you have the right to upload Your Content and that it doesn't infringe anyone else's rights. Recipes imported from third-party sites remain subject to those sites' own rights; Kitchin is a personal organising tool, not a republishing platform.

3. Acceptable use

You agree not to:

• Break the law or infringe others' rights while using the Service.
• Reverse engineer, scrape, or overload the Service, or bypass its limits and security.
• Upload malware or content that is harmful, abusive, or unlawful.
• Resell or commercially exploit the Service without our written permission.

4. Subscriptions and billing

• Kitchin offers a free tier and a paid subscription, Kitchin+.
• Kitchin+ includes a 7-day free trial; unless you cancel before it ends, it converts to a paid subscription.
• Subscriptions renew automatically at the then-current price until cancelled.
• Payments are processed through the Apple App Store or Google Play, and their billing terms also apply.
• You can manage or cancel your subscription in your app store account settings. Except where required by law, payments are non-refundable.

5. AI features

Kitchin uses AI to parse recipes, suggest meal plans, remix recipes, estimate nutrition, and power hands-free cooking. AI output can be inaccurate or incomplete. Always use your own judgement — check ingredients, allergens, cooking temperatures, and times before cooking or eating. Nutrition figures are estimates, not medical or dietary advice.

6. Intellectual property

The Service itself — including its software, design, and the Kitchin name and logo — belongs to Kitchin and is protected by intellectual property laws. These Terms don't grant you any rights to our trademarks or branding.

7. Termination

You can stop using Kitchin and delete your account at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that risks harm to others or to the Service. On termination, your right to use the Service ends, but the sections that by nature should survive will continue to apply.

8. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, to the fullest extent permitted by law. We don't guarantee that the Service will be uninterrupted, error-free, or that imported or AI-generated content will be accurate.

9. Limitation of liability

To the maximum extent permitted by law, Kitchin will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data or profits arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

10. Changes to the Service or Terms

We may update the Service and these Terms over time. If we make material changes to the Terms, we'll notify you in the app or by email. Continuing to use the Service after changes take effect means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Disputes will be resolved in the state or federal courts located in San Francisco, California, unless your local law requires otherwise.
